1. Acceptance of Terms

By accessing or purchasing from Essentials by Day (essentials-by-day.com, the "Site"), operated by Mengel Enterprises LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

2. About Us

Essentials by Day is an e-commerce brand offering curated home and lifestyle products. The Site is operated by Mengel Enterprises LLC, 125 S. Jefferson St., Chicago, IL 60661.

3. Eligibility

You must be at least 18 years of age to make a purchase or create an account on the Site. By using the Site, you represent that you meet this requirement.

4. Products and Availability

We reserve the right to modify, discontinue, or limit quantities of any product at any time without notice. Product images are for illustrative purposes and may not exactly represent the physical product received. Prices are subject to change without notice.

We do our best to display product information accurately, but we do not warrant that product descriptions or other content on the Site is error-free. If a product you ordered is materially different from its description, please contact us at hello@essentialsbyday.com.

5. Orders and Payment

5.1 Order Acceptance

Placing an order does not guarantee acceptance. We reserve the right to refuse or cancel orders at any time, including if a product is out of stock, if there is an error in pricing, or if we suspect fraud.

5.2 Pricing

All prices are listed in U.S. dollars. We reserve the right to correct pricing errors even after an order has been placed, in which case we will notify you and give you the option to proceed at the correct price or cancel.

5.3 Payment

We accept major credit and debit cards and other payment methods displayed at checkout. Payment is processed securely through Shopify Payments and its partners. We do not store your full payment card details.

5.4 Sales Tax

Sales tax will be applied to orders in accordance with applicable state law based on your shipping address.

6. Shipping and Delivery

Please review our Shipping Policy for complete details on shipping methods, estimated delivery times, and costs. Estimated delivery dates are not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss and title to products pass to you upon delivery to the carrier.

7. Returns and Refunds

Generally: most items may be returned within 30 days of delivery in their original, unused condition with original packaging; final sale items and certain product categories may not be eligible for return; refunds are processed to your original payment method within 5-10 business days of receiving the return.

8. Third-Party Fulfillment

Some products available on the Site are fulfilled by third-party suppliers and print-on-demand partners, including Printify, Printful, and Spocket. These products are produced and shipped directly from those suppliers. In the event of a quality issue with a third-party fulfilled product, please contact us and we will work with the supplier to resolve it.

9. Subscriptions

If you enroll in a subscription product through the Site, the following applies: subscriptions renew automatically at the selected frequency until cancelled; you may cancel your subscription at any time through your account or by contacting us; charges occur before each shipment; cancellations must be made at least 24 hours before the next billing date to avoid the next charge.

10. Loyalty Program

We may offer a loyalty rewards program powered by Rivo. Points and rewards are subject to the program's terms, have no cash value, are non-transferable, and may be modified or discontinued at any time.

11. Reviews and User Content

By submitting a product review or other user-generated content to the Site, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute that content in connection with our business. You represent that your content is truthful and does not infringe any third-party rights.

12. Intellectual Property

All content on the Site — including branding, text, images, design elements, and product descriptions — is owned by Mengel Enterprises LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.

13. Prohibited Conduct

You agree not to: use the Site for any unlawful purpose; submit false or fraudulent orders or reviews; attempt to gain unauthorized access to any part of the Site; use automated tools to scrape, index, or purchase from the Site.

14. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MENGEL ENTERPRISES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

16. Governing Law

These Terms are governed by the laws of the State of Illinois without regard to conflict of law provisions. You agree that disputes shall be resolved in the state or federal courts of Cook County, Illinois.
